EL CONSEJO DE LA UNION EUROPEA,

Visto el Tratado constitutivo de la Comunidad Europea y, en particular, su

artículo 113,

Vista la propuesta de la Comisión,

Considerando que, en virtud del artículo 2 del Acta relativa a sus

condiciones de adhesión a la Comunidad, Austria, Finlandia y Suecia

aplicarán el Arancel Aduanero Común a partir del 1 de enero de 1995;

Considerando que, debido a dicha adhesión, será necesario entablar

negociaciones de conformidad con el apartado 6 del artículo XXIV del Acuerdo

General sobre Aranceles Aduaneros y Comercio de 1994 (GATT de 1994) con el

fin de encontrar una solución a los casos en los cuales la aplicación del

Arancel Aduanero Común por parte de los nuevos Estados miembros se traduce

en una modificación o retirada de las concesiones que concedían

anteriormente;

Considerando que la aplicación del Arancel Aduanero Común por los nuevos

Estados miembros se concretará en una reducción de determinados derechos de

importación y un aumento de algunos otros;

Considerando que es razonable que la Comunidad conceda a sus socios

comerciales una compensación temporal por los casos más graves de aumentos

de los derechos de importación; que, en consecuencia, se deberán reducir

algunos de estos derechos de forma unilateral entre el 1 de enero y el 30 de

junio de 1995, fecha en la cual las negociaciones deberían haber llegado a

su término;

Considerando que las instituciones de las Comunidades pueden adoptar, antes

de que se produzca la adhesión, las medidas contempladas en el artículo 169

del Acta, las cuales entrarán en vigor a condición de que lo haga dicho

Tratado, y en la fecha en que ello ocurra,

HA ADOPTADO EL PRESENTE REGLAMENTO:

Artículo 1

1. A partir del 1 de enero de 1995 y hasta el 30 de junio de 1995, la

República de Austria, la República de Finlandia y el Reino de Suecia

aplicarán los derechos de importación indicados en el Anexo a los productos

importados en el marco de los contingentes arancelarios contemplados en el

mismo Anexo.

2. Las disposiciones del apartado 1 se aplicarán a estos productos cuando:

- sean despachados a libre práctica en el territorio de Austria, Finlandia o

Suecia y sean consumidos o sometidos al proceso que confiere la calidad de

productos originarios en dicho territorio, y

- permanezcan bajo vigilancia aduanera en virtud de las disposiciones

comunitarias relativas a la utilización final [artículos 21 y 82 del

Reglamento (CEE) nº 2913/92 del Consejo, del 12 de octubre de 1992, por el

que se establece el Código Aduanero Comunitario].

3. Las disposiciones del apartado 1 sólo serán aplicables si la declaración

de entrada para despacho a libre práctica está acompañada de una

autorización expedida por las autoridades austríacas, finlandesas o suecas

competentes que precise que los productos en cuestión están acogidos a las

disposiciones del apartado 1.

4. La Comisión y las autoridades austríacas, finlandesas o suecas

competentes adoptarán las medidas requeridas para que el consumo final del

producto en cuestión o la operación que le confiera el origen comunitario se

desarrolle en Austria, Finlandia o Suecia.

Artículo 2

El presente Reglamento entrará en vigor en el supuesto de que se produzca la

entrada en vigor del Tratado de adhesión de Austria, Finlandia, Suecia y en

la fecha de la misma.

El presente Reglamento será obligatorio en todos sus elementos y

directamente aplicable en cada Estado miembro.
