Agencia Estatal Boletín Oficial del Estado
La Comisión Delegada del Gobierno para Asuntos Económicos, en su
reunión del día 21 de junio de 2001, adoptó un acuerdo por el que, a
propuesta del Ministerio de Economía, se resuelven expedientes de
solicitud de los incentivos regionales previstos en la Ley 50/1985.
Considerando la naturaleza de dicho acuerdo, este Ministerio tiene
a bien disponer:
Dar publicidad en el "Boletín Oficial del Estado" al texto del acuerdo
de la Comisión Delegada del Gobierno para Asuntos Económicos de fecha
21 de junio de 2001. Dicho texto, con relación nominal de las empresas
afectadas, se incluye como anexo a esta Orden ministerial.

ANEXO
Texto del acuerdo de la Comisión Delegada del Gobierno
para Asuntos Esconómicos
La Ley 50/1985, de 27 de diciembre, sobre incentivos regionales,
desarrollada reglamentariamente por el Real Decreto 1535/1987, de 11
de diciembre, modificado por los Reales Decretos 897/1991, de 14 de junio;
302/1993, de 26 de febrero, y 2315/1993, de 29 de diciembre, constituye
un instrumento para las actuaciones de ámbito estatal, dirigidas a fomentar
las iniciativas empresariales con intensidad selectiva en determinadas
regiones del Estado con objeto de repartir equilibradamente las actividades
económicas dentro del mismo.
Los Reales Decretos 491/1988, de 6 de mayo, modificado por el Real
Decreto 2486/1996, de 5 de diciembre; 487/1988, de 6 de mayo, modificado
por los Reales Decretos 528/1992, de 22 de mayo y 2488/1996, de 5 de
diciembre; 488/1988, de 6 de mayo, modificado por el Real
Decreto 303/1993, de 26 de febrero; 489/1988, de 6 de mayo; 490/1988 y 568/1988,
de 6 de mayo, modificados por los Reales Decretos 133/1992, de 4 de
febrero, y 2488/1996, de 5 de diciembre, y 530/1992, de 22 de mayo;
569/1988 y 570/1988, de 3 de junio, modificado este último por el Real
Decreto 2487/1996, de 5 de diciembre; 652/1988, de 24 de junio; 1389/1988,
de 18 de noviembre, modificado por el Real Decreto 1397/1992, de 20
de noviembre, y 883/1989, de 14 de julio, modificado por los Reales
Decretos 852/1992, de 10 de julio, y 2489/1996, de 5 de diciembre, delimitan
la Zona Promocionable de Aragón y las Zonas de Promoción Económica
de Asturias, Murcia, Castilla-La Mancha, Cantabria, Galicia, Canarias,
Castilla-León, Andalucía, Extremadura y Comunidad Valenciana.
Se han presentado solicitudes para acogerse a estos incentivos
regionales, acogiéndose a los Reales Decretos de delimitación citados, y se han
tramitado las mismas de conformidad con la legislación que les afecta;
una vez estudiadas dichas solicitudes por el Consejo Rector, se elevan
las respectivas propuestas de concesión a esta Comisión Delegada del
Gobierno para Asuntos Económicos, al amparo de lo dispuesto en el
artículo 27 del Real Decreto 1535/1987, de 11 de diciembre.
ACUERDO
Primero. Concesión de incentivos regionales.-Se conceden
incentivos regionales a los proyectos de inversión que se relacionan en el anexo I
de este acuerdo, en el que se indican el importe de los mismos, la inversión
incentivable y los puestos de trabajo a crear.
Segundo. Modificación de condiciones.-En el anexo II se relacionan
los expedientes de modificación de condiciones que han sido resueltos,
describiéndose la totalidad de los cambios autorizados en la
correspondiente resolución individual.
Tercero. Resoluciones individuales.
1. La Dirección General de Políticas Sectoriales notificará
individualmente a las empresas, a través del órgano competente de la Comunidad
Autónoma, las condiciones generales y particulares que afectan a cada
proyecto mediante las correspondientes resoluciones individuales.
2. La resolución sobre concesión de beneficios que sea expedida por
aplicación de lo dispuesto en el presente acuerdo no exime a las empresas
de cumplir los requisitos y obtener las autorizaciones administrativas que,
para la instalación o ampliación de las industrias, exijan las disposiciones
legales vigentes, nacionales o cumunitarias, así como la normativa de la
respectiva Comunidad Autónoma y las correspondientes ordenanzas
municipales.
3. Los titulares de las subvenciones concedidas por el presente
acuerdo quedan sujetos al cumplimiento de lo establecido en la Orden del
Ministerio de Economía y Hacienda de 28 de abril de 1986, sobre justificación
del cumplimiento de las obligaciones tributarias, y en la Orden de 25 de
noviembre de 1987, sobre justificación del cumplimiento de las obligaciones
frente a la Seguridad Social.
Disposición adicional primera.-Se faculta a la Dirección General de
Políticas Sectoriales para que pueda autorizar modificaciones, en más o
menos y hasta un 10 por 100, respecto del importe de la subvención
concedida, de la inversión aprobada o del número de puestos de trabajo.
Disposición adicional segunda.-La adquisición de los derechos por los
perceptores de las subvenciones que puedan derivarse del presente acuerdo
queda condicionado a la existencia de crédito adecuado y suficiente y
a la aprobación del correspondiente expediente de gasto por el órgano
competente, previa la preceptiva fiscalización favorable de la Intervención.
Disposición adicional tercera.-El abono de las subvenciones a que dé
lugar el presente acuerdo quedará sometido a la tramitación y aprobación
del oportuno expediente de gasto, que ha de incoarse con cargo al
correspondiente crédito cifrado en la sección 24 "Economía", rúbrica
24.10.724C.771 del vigente presupuesto, en el momento de presentarse
la primera liquidación de subvención.
Cuando la subvención se cofinancie por los Fondos Estructurales de
la Comisión Europea, su abono quedará sometido a la tramitación
específica exigida para la percepción de ayudas por dichos Fondos, así como
a las disposiciones de control y seguimiento de la Unión Europea.
Disposición adicional cuarta.-Los pagos parciales, que tendrán el
carácter de pagos a cuenta, estarán debidamente afianzados y sujetos a
inspecciones y rectificaciones, en su caso, de acuerdo con la normativa vigente.
En caso de incumplimiento de las condiciones establecidas, tanto en
la normativa vigente como en la resolución individual, el beneficiario estará
obligado a reintegrar las cantidades que hubiera recibido, con abono de
los intereses legales correspondientes y del recargo y sanciones, si
proceden, sin perjuicio de la aplicación, cuando proceda, de los preceptos
sobre delitos contra la hacienda pública, conforme a lo dispuesto en el
artículo 7 de la Ley 50/1985, de 27 de diciembre.
