EL CONSEJO DE LAS COMUNIDADES EUROPEAS,

Visto el Tratado constitutivo de la Comunidad Económica Europea y, en particular, su artículo 1 13,

Vista la propuesta de la Comisión,

Considerando que, en espera de que concluyan los procedimientos necesarios para su celebración, el Acuerdo entre la Comunidad Económica Europea y Hong Kong sobre el comercio de productos textiles, rubricado el 2 de octubre de 1986, se aplica provisionalmente desde el I de enero de 1987, de conformidad, en lo que se refiere a la Comunidad, con la Decisión 88/213/CEE (1) :

Considerando que dicho Acuerdo prevé la posibilidad de volver a examinar los ajustes cuantitativos de las cuotas para determinadas categorías, con objeto de tener en cuenta la introducción de la nomenclatura combinada:

Considerando que, tras las consultas que han tenido lugar entre la Comunidad y Hong Kong, ha sido rubricada, el 29 de julio de 1988, un acta aprobada que modifica las cuotas de los productos de las categorías 7 y 78 prevista en el Acuerdo;

Considerando que, en espera de que concluyan los procedimientos necesarios para la celebración del Acuerdo y del acta aprobada, es conveniente aplicar provisionalmente el acta aprobada, con efecto a partir del I de enero de 1988, a reserva de una aplicación provisional por parte de Hong Kong con carácter de reciprocidad,

DECIDE:

Artículo 1 En espera de que concluyan los procedimientos necesarios para su celebración, se aplicará provisionalmente en la Comunidad el acta aprobada por la que se modifica el Acuerdo sobre el comercio de productos textiles entre la Comunidad Económica Europea y Hong Kong con efecto a partir del I de enero de 1988, a reserva de una aplicación provisional por parte de Hong Kong con carácter de reciprocidad.

El texto del acta aprobada se adjunta a la presente Decisión.

Artículo 2 Se invita a la Comisión a recabar el acuerdo del Gobierno de Hong Kong sobre la aplicación provisional del acta aprobada contemplada en el artículo 1 y a comunicarlo al Consejo.

I. A delegation of the Hong Kong Government and a delegation of the European Community met in Brussels on 27 July 1988 for consultations on problems arising from the adoption, following introduction of the harmonized system, of the revised definitions of blouses, both knitted and woven, as set out in the explanatory notes to the combined nomenclature (CN) Chapters 61 and 62 concerning shirts, shirt-blouses and blouses for women or girls (category 7). The consultations were conducted in accordance with Article 14 (1) of the Agreement on Trade in Textile products between Hong Kong and the Community initialled on 2 October 1986 in Brussels.

2. As a result of the consultations and having regard to the migration of woven tops.with shoulder straps and woven tops without opening from category 78 to category 7, the two parties agreed to add the following quantities to the quantitative limits for category 7 established in Annex II of the said Agreement:

and to deduct the following quantities from the quantitative limits for category 78 established in Annex II of the said Agreement:

3. It was further agreed that the regional shares for category 7 for the year 1988 as indicated in the Annex to the Community's Note Verbale No 02728 dated 4 March 1988 will be increased in consequence of the additional quantity for category 7 referred to in paragraph 2 above by the following quantities:

4. As regards the regional shares for category 78 for the year 1988 as indicated in the Annex to the Community's Note Verbale No 02728 dated 4 March 1988, it was agreed that they will be decreased in consequence of the quantities to be deducted from category 78 referred to in paragraph I above by the following quantities:

I.
