Vista la solicitud del Museo Nacional Centro de Arte Reina Sofía.
De acuerdo con la disposición adicional novena de la Ley 16/1985, de 25 de junio, del Patrimonio Histórico Español y el Real Decreto 1680/1991, de 15 de noviembre, por el que se desarrolla dicha disposición adicional sobre garantía del Estado para obras de interés cultural y la disposición adicional quincuagésima octava de la ley 6/2018, de 3 de julio, de Presupuestos Generales del Estado para el año 2018.
Vistos los informes favorables del Servicio Jurídico del Ministerio de Cultura y Deporte de fecha de 9 de julio de 2018, y de la Oficina Presupuestaria del Departamento de fecha de 9 de julio de 2018, y de la Junta de Calificación, Valoración y Exportación de Bienes del Patrimonio Histórico Español de su reunión plenaria del día 23 de mayo de 2018, y una vez fiscalizado de conformidad por la Intervención Delegada en el Departamento.
De conformidad con la propuesta de la Dirección General de Bellas Artes, dispongo:
Otorgar la garantía del Estado a las obras que figuran en el Anexo de esta orden con el alcance, efectos y límites que más adelante se expresan.
1. El Estado se compromete a indemnizar por la destrucción, pérdida, sustracción o daño de las obras que figuran en el Anexo de esta orden, de acuerdo con los valores y las condiciones expresadas en la documentación que figura en el expediente.
2. Cualquier alteración de las condiciones expresadas en la solicitud deberá ser comunicada con antelación suficiente al Ministerio de Cultura y Deporte por la institución solicitante, siendo necesaria la conformidad expresa del mismo para que la garantía surta efecto en relación con el término alterado.
1. La Garantía otorgada se circunscribe exclusivamente a los bienes culturales que figuran en el Anexo de esta Orden Ministerial, a los efectos de su exhibición en el Museo Nacional Centro de Arte Reina Sofía en la exposición «Dorothea Tanning. Doors of wonder» entre el 2 de octubre de 2018 al 7 de enero de 2019.
2. El valor económico total de las obras cubiertas por la Garantía del Estado asciende a 25.533.796,55 (veinticinco millones quinientos treinta y tres mil setecientos noventa y seis euros y cincuenta y cinco céntimos). Dado que la valoración de varias de las obras cubiertas por la garantía se encuentra expresada en divisas, el valor económico total expresado en esta Orden es una aproximación en euros al valor total de la exposición, utilizando para ello los contravalores resultantes de la aplicación de los tipos de cambio del euro fijados por Resolución del Banco de España por la que se hacen públicos los cambios del euro correspondientes al día 4 de mayo de 2018 (BOE de 5 de mayo de 2018). A los efectos de esta Orden, se considerará que el valor individual de las obras es el que figura en la solicitud de garantía del Estado.
3. Las cantidades no cubiertas por la Garantía del Estado, según lo dispuesto en el artículo 6.2 del Real Decreto 1680/1991, de 15 de noviembre, deberán ser aseguradas por la Institución solicitante de la garantía o los cedentes de las obras.
1. El periodo de cobertura de la Garantía del Estado se iniciará el 20 de agosto de 2018 y surtirá efecto desde la entrega de las obras por parte del cedente hasta la devolución de las mismas en su lugar de origen o a la siguiente sede en la Tate Gallery de Londres (según figura en la solicitud del museo), con fecha límite de 11 de febrero de 2019.
2. En caso de ampliación de la exposición, la Garantía del Estado podrá prorrogarse, a petición de la institución solicitante, previa conformidad del Ministerio de Cultura y Deporte. El acuerdo de conformidad expresará el plazo de vigencia de la Garantía y las obras a las que resulta de aplicación la prórroga.
1. Previamente a la entrega de las obras garantizadas en sus lugares de recogida, personal técnico cualificado elaborará un informe exhaustivo sobre el estado de conservación de cada una de ellas. Obtenida la conformidad escrita de cedente y cesionario sobre dicho informe, se procederá por parte de ambos a la firma del acta de entrega.
2. El acta de devolución se firmará en el momento de entrega de las obras a los cedentes en sus lugares de origen o en la siguiente sede en la Tate Gallery de Londres (según figura en la solicitud del museo). En el acta de devolución deberá constar la conformidad de cedente y cesionario acerca de las condiciones en que se encuentran las mismas.
Sin perjuicio de las restantes obligaciones que figuran en esta orden, la institución solicitante de la garantía deberá:
1.º Enviar a la Subdirección General de Protección del Patrimonio Histórico del Ministerio de Cultura y Deporte certificado extendido por su Director acreditando el término de la garantía otorgada, y cualquier circunstancia que afecte a la misma, en el plazo de cuarenta y ocho horas a partir de la devolución de las obras.
2.º Adoptar todas las medidas necesarias para garantizar la seguridad y conservación de la obra así como el estricto cumplimiento de lo dispuesto en esta Orden.
Se incorpora a esta orden, formando parte de la misma, el Anexo que se cita en el apartado segundo.
La Dirección General de Bellas Artes del Ministerio de Cultura y Deporte dará inmediata cuenta, por vía telemática, del otorgamiento del compromiso del Estado y del contenido del mismo a las Cortes Generales y al Ministerio de Hacienda.
