Visto el Tratado de Funcionamiento de la Unión Europea, y en particular su artículo 127, apartado 2, cuarto guion,
Vistos los Estatutos del Sistema Europeo de Bancos Centrales y del Banco Central Europeo, y en particular sus artículos 3.1, 17, 22 y 23,
Considerando lo siguiente:

El 11 de junio de 2021 el Consejo de Gobierno decidió que una funcionalidad para la liquidación de transferencias entre monedas distintas en el servicio de liquidación de pagos inmediatos de TARGET (TIPS) era acorde con los objetivos estratégicos del Eurosistema. Conforme a esta decisión, la Orientación (UE) 2022/912 del Banco Central Europeo (BCE/2022/8) (1) (en lo sucesivo, la «Orientación sobre TARGET») fue modificada por la Orientación (UE) 2026/1473 del Banco Central Europeo (BCE/2026/11) (2) a fin de que, a partir del 14 de noviembre de 2026, TIPS permita enviar y recibir pagos a o por participantes en TIPS que se adhieran al Esquema SEPA de transferencias inmediatas One-Leg Out del Consejo Europeo de Pagos (OCT Inst).

Con las modificaciones de la Orientación sobre TARGET se introdujo también un servicio que permite a los participantes gestionar mejor su liquidez, al posibilitar los traspasos de liquidez automatizados entre las cuentas principales de efectivo (MCA) de un participante y sus cuentas dedicadas de efectivo de TIPS (DCA TIPS) cuando se incumpla un límite mínimo o máximo fijado por el participante.

Otras modificaciones de la Orientación sobre TARGET afectan a las condiciones de TARGET-ECB, incluidas las comisiones para los titulares de cuentas dedicadas de efectivo para la liquidación bruta en tiempo real, y deben reflejarse en la Decisión (UE) 2022/911 del Banco Central Europeo (BCE/2022/22) (3).

Debe modificarse en consecuencia la Decisión (UE) 2022/911 (BCE/2022/22).

HA ADOPTADO LA PRESENTE DECISIÓN:
Artículo 1
Modificaciones
Los anexos de la Decisión (UE) 2022/911 (BCE/2022/22) se modifican como sigue:
1) El anexo I se modifica conforme al anexo I de la presente Decisión.
2) El anexo III se modifica conforme al anexo II de la presente Decisión.
3) El anexo I se modifica con efectos a partir del 14 de noviembre de 2026 conforme al anexo III de la presente Decisión.
4) El anexo III se modifica con efectos a partir del 14 de noviembre de 2026 conforme al anexo IV de la presente Decisión.
Artículo 2
Entrada en vigor
La presente Decisión entrará en vigor el quinto día siguiente al de su publicación en el Diario Oficial de la Unión Europea.

By setting a floor and opting for a rule-based liquidity transfer order, if, following the settlement of an instant payment order, a positive recall answer or a liquidity transfer order, the floor is breached, a rule-based liquidity transfer order is initiated that debits an MCA authorised by the MCA holder.
