LA COMISIÓN EUROPEA,

Visto el Tratado de Funcionamiento de la Unión Europea,

Vista la Directiva 89/662/CEE del Consejo, de 11 de diciembre de 1989, relativa a los controles veterinarios aplicables en los intercambios intracomunitarios con vistas a la realización del mercado interior (1), y en particular su artículo 9, apartado 4,

Vista la Directiva 90/425/CEE del Consejo, de 26 de junio de 1990, relativa a los controles veterinarios y zootécnicos aplicables en los intercambios intracomunitarios de determinados animales vivos y productos con vistas a la realización del mercado interior (2), y en particular su artículo 10, apartado 4,

Considerando lo siguiente:

La Decisión de Ejecución (UE) 2017/247 de la Comisión (3) se adoptó a raíz de la aparición de brotes de gripe aviar altamente patógena del subtipo H5 en varios Estados miembros («los Estados miembros afectados») y del establecimiento de zonas de protección y de vigilancia por la autoridad competente de los Estados miembros afectados, de conformidad con el artículo 16, apartado 1, de la Directiva 2005/94/CE del Consejo (4).

La Decisión de Ejecución (UE) 2017/247 dispone que las zonas de protección y de vigilancia establecidas por las autoridades competentes de los Estados miembros afectados de conformidad con la Directiva 2005/94/CE deben abarcar, como mínimo, las zonas de protección y de vigilancia indicadas en el anexo de dicha Decisión de Ejecución. La Decisión de Ejecución (UE) 2017/247 dispone asimismo que las medidas que deben aplicarse en las zonas de protección y de vigilancia, tal como se prevé en el artículo 29, apartado 1, y el artículo 31 de la Directiva 2005/94/CE, se mantengan, como mínimo, hasta las fechas correspondientes a las zonas de protección establecidas en el anexo de la mencionada Decisión de Ejecución.

Desde la fecha de su adopción, la Decisión de Ejecución (UE) 2017/247 ha sido modificada en varias ocasiones con el fin de tener en cuenta la evolución de la situación epidemiológica en la Unión en lo que respecta a la gripe aviar. En particular, la Decisión de Ejecución (UE) 2017/247 se modificó mediante la Decisión de Ejecución (UE) 2017/696 de la Comisión (5) a fin de establecer normas relativas al envío de partidas de pollitos de un día procedentes de las zonas enumeradas en el anexo de la Decisión de Ejecución (UE) 2017/247. Esta modificación tuvo en cuenta el hecho de que los pollitos de un día presentan un riesgo muy bajo de propagación de la gripe aviar altamente patógena, en comparación con otros productos de aves de corral.

Además, la Decisión de Ejecución (UE) 2017/247 fue modificada posteriormente por la Decisión de Ejecución (UE) 2017/1841 de la Comisión (6) con el fin de reforzar las medidas de control de la enfermedad aplicables cuando existe un mayor riesgo de propagación de la gripe aviar altamente patógena. Por consiguiente, en la Decisión de Ejecución (UE) 2017/247 se dispone ahora el establecimiento a nivel de la Unión de nuevas zonas restringidas en los Estados miembros afectados, tal como se menciona en el artículo 16, apartado 4, de la Directiva 2005/94/CE, a raíz de uno o varios brotes de gripe aviar altamente patógena, así como la duración de las medidas que se aplicarán en las mismas. La Decisión de Ejecución (UE) 2017/247 también establece ahora normas para el envío de aves de corral vivas, pollitos de un día y huevos para incubar desde las nuevas zonas restringidas a otros Estados miembros, siempre que se cumplan determinadas condiciones.

Además, el anexo de la Decisión de Ejecución (UE) 2017/247 ha sido modificado en numerosas ocasiones para tener en cuenta los cambios en los límites de las zonas de protección y de vigilancia establecidas por los Estados miembros afectados de conformidad con la Directiva 2005/94/CE. El anexo de la Decisión de Ejecución (UE) 2017/247 fue modificado por última vez mediante la Decisión de Ejecución (UE) 2017/1845 de la Comisión (7) tras la notificación por Italia de nuevos brotes de gripe aviar altamente patógena del subtipo H5N8 en explotaciones de aves de corral en las regiones de Lombardía y Véneto, y el establecimiento de zonas de protección y de vigilancia, y de nuevas zonas restringidas, por ese Estado miembro en torno a las explotaciones avícolas infectadas, con arreglo a lo dispuesto en la Directiva 2005/94/CE.

Desde la fecha de la última modificación de la Decisión de Ejecución (UE) 2017/247 por la Decisión de Ejecución (UE) 2017/1845, Italia ha notificado a la Comisión nuevos brotes de gripe aviar altamente patógena del subtipo H5N8 en explotaciones de aves de corral situadas en las regiones de Lombardía, Véneto y Emilia-Romaña de dicho Estado miembro. Además, Bulgaria ha notificado recientemente a la Comisión un brote de gripe aviar altamente patógena del subtipo H5N8 en una explotación en la que se crían patos situada en la región de Dobrich de dicho Estado miembro.

Italia y Bulgaria también han notificado a la Comisión que han adoptado las medidas necesarias exigidas de conformidad con la Directiva 2005/94/CE, incluido el establecimiento de zonas de protección y de vigilancia en torno a todas las explotaciones infectadas. Asimismo, Italia ha notificado a la Comisión que ha ampliado las nuevas zonas restringidas establecidas en torno de las zonas de vigilancia en determinadas áreas en las que existe un mayor riesgo de propagación de la gripe aviar altamente patógena.

La Comisión ha examinado las medidas adoptadas por Italia y Bulgaria con arreglo a la Directiva 2005/94/CE a raíz de los recientes brotes de gripe aviar altamente patógena en dichos Estados miembros, y se ha cerciorado de que los límites de las zonas de protección y de vigilancia y, en el caso de Italia, las nuevas zonas restringidas, establecidas por las autoridades competentes de esos dos Estados miembros, se encuentran a una distancia suficiente de toda explotación en la que se haya confirmado un brote de gripe aviar altamente patógena del subtipo H5N8.

Con objeto de prevenir cualquier perturbación innecesaria del comercio dentro de la Unión y evitar la imposición de obstáculos injustificados al comercio por parte de terceros países, es necesario describir rápidamente a nivel de la Unión, en colaboración con Italia y Bulgaria, las zonas de protección y de vigilancia establecidas por Italia y Bulgaria, y las nuevas zonas restringidas establecidas en Italia, de conformidad con la Directiva 2005/94/CE, tras los recientes brotes de gripe aviar altamente patógena en dichos Estados miembros. Por tanto, deben actualizarse las entradas correspondientes a Italia y Bulgaria en el anexo de la Decisión de Ejecución (UE) 2017/247 para tener en cuenta la situación epidemiológica actualizada de estos dos Estados miembros por lo que respecta a esa enfermedad. En particular, deben añadirse a las listas del anexo de la Decisión (UE) 2017/247 las nuevas entradas para las zonas de las regiones de Lombardía, Véneto y Emilia-Romaña en Italia, y las zonas de la región de Dobrich, en Bulgaria, que están ahora sometidas a restricciones de conformidad con la Directiva 2005/94/CE.

Por consiguiente, debe modificarse el anexo de la Decisión de Ejecución (UE) 2017/247 para actualizar la regionalización a nivel de la Unión con el fin de incluir las zonas de protección y de vigilancia establecidas en Italia y Bulgaria, y las nuevas zonas restringidas establecidas en Italia, de conformidad con la Directiva 2005/94/CE, tras los recientes brotes de gripe aviar altamente patógena en estos dos Estados miembros, así como la duración de las restricciones aplicables en ellas.

Procede, por tanto, modificar la Decisión de Ejecución (UE) 2017/247 en consecuencia.

Las medidas previstas en la presente Decisión se ajustan al dictamen del Comité Permanente de Vegetales, Animales, Alimentos y Piensos.

HA ADOPTADO LA PRESENTE DECISIÓN:

Artículo 1

El anexo de la Decisión de Ejecución (UE) 2017/247 queda modificado con arreglo a lo dispuesto en el anexo de la presente Decisión.

Artículo 2

Los destinatarios de la presente Decisión serán los Estados miembros.
